Staffers in remote locations often have more freedom to operate than those in closer, easily monitored location. But Richard Bistrong, who approaches compliance with the insights of an FCPA violater, believes this out of sight, out of mind approach heightens the risk of compliance violations – especially when successful sales personnel are given too much rein. “The reward for success is more pressure to achieve even more success, and the sales people are given the tools and latitude to do that,” he argues. He says that given too much discretion over such tools as discounts, success fees for third parties, and commissions, some will follow in his footsteps and play fast and loose with the rules – and that means more oversight, not less should be the rule for far flung personnel.
